Terms and Conditions
Dealer Set-up:
Credit application & tax forms must be completed mailed, faxed or emailed and approved prior to placing orders. For any questions regarding this process, please email or call.
Terms:
Acceptable terms are cash, C.O.D., credit card or pre-approved credit. If we have your valid credit card on file, we will charge your card when your order is ready to leave our warehouse. Past due invoices incur late fees of 1.5% per month. Credit card service charge is 3.5%. Drop ship orders are charged to customer credit card on file upon shipping of order.
Backorders:
We cancel all back orders. You will need to reorder any backorders with your next order.
Prices:
Mercantile Intl. reserves the right to change prices without prior notice. Orders are accepted only at prices and terms in effect at the time of shipment.
Freight:
All shipments are FOB New Brunswick, NJ. (Ownership of the product passes to customer at our door and customer pay the shipping costs). Pallet orders are usually shipped by 3 rd party trucking companies.
UPS ground service is the usual method for small shipments unless another method is specified. Charges are usually prepaid and added to your invoice.
Drop-Ship Service:
Product may be shipped directly to your customer. Drop-ship fee is $3.00 per box. Drop-ship fee to APO addresses and packages shipped by US Mail is $5.00 per box. Drop-ship orders cannot be shipped C.O.D. UPS freight is prepaid and added to your invoice. Returns from drop ship sales will not be accepted. You will take returns back from your customers and stock it for further resale.
Changes to these Terms of Service
Mercantile reserves the right, at its sole discretion, to change, modify, add or remove any portion of these Terms of Service in whole or in part, at any time. Changes in these Terms of Service will be effective when notice of such change is posted. Your continued use of the Site after any changes to these Terms of Service are posted will be considered acceptance of those changes. You should periodically visit this page to determine the then current Agreement.
Shortages:
Mercantile Intl attempts to ship all orders accurately and are double checked before packing. You must check your order thoroughly as soon as it is received. If there is a problem, it must be reported to Mercantile Intl within 2 days of receipt. Claims received after two (2) business days cannot be considered.
Transit Losses:
Title to merchandise passes to the purchaser on delivery to the carrier by Mercantile Intl. You are responsible to follow up on loss or damage in transit. You should thoroughly inspect each shipment as soon as it is received. Be sure your carrier makes an "exception" note of all visible damages and shortages on the Bill of Lading. All claims should be filed directly with the carrier. However, UPS may require claims to be filed by the shipper. In that case, contact Mercantile Intl to initiate the process.
Defects & Warranties:
Products are warranted by their respective manufacturers. If a product defect is discovered, contact manufacturer immediately for warranty/service. Mercantile Intl. handles warranty/service for Chef Pro, Eris & Majestic Art Elements product Lines.
Returns:
No returns will be accepted without prior authorization. Unauthorized returns will not be accepted. Returns which are authorized will be inspected before acceptance and before service, replacement or credit is issued. Any product returned must be returned within 14 days of purchase, be factory fresh, packed in original boxes, free of store pricing or markings and must be shipped freight prepaid. No collect shipments will be accepted. A 20% restocking fee will apply.
Bad Checks:
Bad checks incur a fee of $25.00 per check.
